This Privacy Policy (“Privacy Policy”), effective as of 26 January 2024 (“Effective Date”), explains how Discflo Corporation (hereinafter, “Discflo”) collects and uses information when you, the end-user (hereinafter, “You” or “Your”), visit the “Discflo Website” located at https://www.discflo.com, and any other subpages or applications on the “discflo.com” domain which Discflo may create, remove, or modify at its sole discretion), when You access or request services through the Discflo Website (all references to capitalized terms not defined herein are to have the same meaning as those terms defined in the Discflo Terms of Use, located at: www.discflo.com/terms-and-conditions.

This Privacy Policy is published at: www.discflo.com/privacypolicy and applies to all users of the Discflo Website, users of any other websites or applications with Discflo branding that link to this Privacy Policy or any other Discflo terms and conditions for the Discflo Website and/or services offered therein, and where links thereto are published in any other terms, conditions, policies, or similar such items.

If You do not agree with this Privacy Policy, please do not use the Discflo Website, schedule any services through the Discflo Website, or otherwise interact with the Discflo Website. By using the Discflo Website and/or requesting any services through the Discflo Website, You consent to this Privacy Policy. This Privacy Policy does not apply to other websites to which Discflo may otherwise link, or to other companies, third-party vendors who provide services to Discflo, or entities who might be listed as third-party contacts on the Discflo Website., each of which may be governed by their own privacy policies. This Privacy Policy applies to information collected through the Discflo Website and any other information collected in any other manner in other interactions, whether over the internet, phone, in-person, or any other medium of communication with Discflo or its employees, agents, affiliates, partners, successors, or assigns.

Types of Personally Identifiable Information Collected. Personally identifiable information is information that can be used to identify, locate, or contact You (“Personal Information”). It also includes other information that may be associated with Personal Information. Discflo collects information from You when You visit and/or schedule services through the Discflo Website. The following information may be collected by Discflo from You:

  • Information when You request services through the Discflo Website, such as Your first name, last name, email address, and phone number;
  • Transaction information provided by You when requesting services;
  • Phone calls between Discflo and You, and any information contained therein;
  • Information You provided on Discflo documents and forms;
  • Location information, including location information provided by a laptop computer, tablet, mobile smartphone, or other similar such device interacting with the Discflo Website, or associated with Your IP address or other online identifier, where Discflo is permitted by law to process such information;
  • Images or recordings or any other similar such materials in any medium which may contain Your Personal Information;
  • Activity information about Your use of the Discflo Website, such as content viewed, how often You use the Discflo Website, and Your preferences.

The above-referenced information constitutes Personal Information and as such, is subject to the terms and conditions of this Privacy Policy. Discflo does not possess or otherwise obtain or distribute any of Your sensitive information (e.g., government identifiers, account logins, or as otherwise defined in the California Consumer Privacy Act).

From time to time, Discflo may also supplement Personal Information with information collected from third parties, including demographic information about You interests and similar information that third parties have collected from other sources, for the purposes of validating the accuracy of Your information, to better understand You, to provide You with targeted advertising, and to improve the delivery of the Discflo Website and/or any Services obtained through the Discflo Website to You.

How Information is Collected. Discflo asks for the Personal Information listed above as part of a process to request information and/or services from Discflo, and also collects information when purchasing services from Discflo, or visiting the Discflo Website. When either Discflo or You initiate a call with the other party, Discflo may monitor and/or record those calls for quality assurance and customer satisfaction purposes. In those jurisdictions where consent is required for a party to record a telephone call, You consent to Discflo recording such calls.

Discflo may collect Your precise location data through the Discflo Website. Discflo collects this information to help enable the functionality of the Discflo Website, and Discflo may also collect the precise location of Your device when You access the Discflo Website via that device. Discflo may also derive Your location through Your IP address. The Discflo Website uses geo-location features to help enable You to search for services that may be obtained through the Discflo Website, to improve the Discflo Website and/or any services that may be obtained on the Discflo Website, and/or for any other reasonable business purpose of Discflo, such as a legal purpose, a merger or sale of Discflo, or any business-related asset transfers. The geo-location data obtained about You will be stored in an identifiable manner, along with geo-location data about any project sites where You requested or performed services obtained through the Discflo Website. In addition to tracking Your geo-location, the Discflo Website may also track Your activity across third-party applications and websites. This allows Discflo to deliver an enhanced experience when You visit the Discflo Website and/or request information or services from Discflo. If at any time, You decide that You do not want to share Your geolocation data and/or activity with the Discflo Website, You can opt-out at any time by changing the relevant settings in Your internet browser.

Discflo may collect information about Your mobile device or other device You use in accessing the Discflo Website, including, but not limited to, the following information: the hardware model, operating system and version of that operating system, software and/or application names and version numbers, file names and version numbers, preferred language of the device, unique device identifiers, advertising identifiers, device serial number, device motion information, and mobile network information. Information is used to communicate with You about information and services from Discflo, to provide personalized content, to provide additional information that may be of interest to You about Discflo’s services or any of its subsidiaries, affiliates, or partners (such as special offers, promotions, announcements, and information about potential service offerings), and to detect, prevent, and investigate activities which may violate Discflo terms and conditions, or otherwise be fraudulent, illegal, and/or pose safety issues to Discflo or any third-parties using the Discflo Website or services.

Cookies, Web Beacons, Clear-GIFs, Pixel Tags, JavaScript, and Third-Party Technologies. Discflo may use cookies and other identification technologies on Discflo’s Website, emails, and online ads for the purposes described in this Privacy Policy. Cookies are small text files that are stored on your browser or device by websites, apps, online media, and advertisements. Discflo uses cookies and similar technologies for purposes including, but not limited to, the following:

  • Remembering Your preferences and settings;
  • Determining the popularity of content; and
  • Delivering and measuring the effectiveness of advertising campaigns; and
  • Analyzing site traffic and trends, and generally understanding the online behaviors and interests of people who interact with the Services.

Discflo may use “pixel tags” (also called “action pixels,” “web beacons,” or “clear gifs”) and/or JavaScript plug-ins, placed on the Discflo Website and in Discflo emails to You. These web beacons and plug-ins are small graphic images (typically that you cannot see) or codes on a website or in an email message which are used for such things as recording webpages and advertisements clicked on by a user or for tracking the performance of email marketing campaigns. These devices help Discflo analyze online behavior and measure the effectiveness of the Discflo Website and marketing. Discflo may collect “Server Log” information, which is a record of activity created by a computer that delivers certain webpages to Your internet browser. Certain activities that You perform on our Website may record information in Server Logs. For example, if You enter a search term into a search box located on the Website, the Server Log may record the search term, the link You clicked on to bring You to our Website, and/or information about Your browser, such as Your IP address and the cookies set on Your browser.

Discflo may also work with third-party service providers that help Discflo track, collect, and analyze this information. Third-party entities with whom Discflo has agreements may place these devices on the Discflo Website and/or in emails to use information obtained from them, such as pages viewed, items purchased, emails opened, and items upon which You may click in emails. These third-party providers may also place cookies onto Your computer. Those third-party cookies may enable us to obtain aggregate demographic information and user statistics about you and your preferences from these third-party sources, as well as Discflo’s own information about You. Discflo may also allow others to provide audience measurement and analytics services for Discflo, to serve advertisements on Discflo’s behalf across the internet, and to track and report on the performance of those advertisements. These entities may use cookies, web beacons, and other technologies to identify Your device when You visit the Discflo Website as well as when You visit other internet sites and services.

How Discflo Uses Personal Information. The primary purpose of the Personal Information collected on the Discflo Website is to improve, optimize, and further develop the Discflo Website. Your Personal Information is used to communicate with You about transactions with Discflo, to provide personalized content and experiences, to provide additional information that may be of interest to You about the Discflo Website, Discflo, and/or any of its subsidiaries, affiliates, or partners (such as special offers, promotions, announcements, and information about potential service offerings), and to detect, prevent, and investigate activities which may violate Discflo policies, terms, or conditions, or otherwise be fraudulent, illegal, and/or pose safety issues.

Specifically, Discflo may use Personal Information for business purposes, including but not limited to: (i) providing services You may seek; (ii) analyzing trends and conducting research; (iii) providing support and responding to questions from users, Discflo Website visitors and customers; (iv) improving the Discflo Website or services; (v) learning about user and customer needs; (vi) contacting users for research, informational, and marketing purposes, including customizing the Discflo Website for You based upon Your information and browsing habits; (vii) tracking traffic patterns and Discflo Website usage; (viii) providing customer service and technical support; (ix) correlating Personal Information with other commercially available information to identify demographics and preferences to assist Discflo in research and marketing efforts; (x) providing specific relevant marketing, promotional, or other information to You; (xi) addressing information security and/or privacy practices, network functionality, engineering, and/or troubleshooting issues; (xii) investigating legal actions, violations of law, contractual violations, and compliance with relevant applicable laws and legal processes; (xiii) complying with applicable laws, or based on Discflo’s good faith belief that use of Personal Information is necessary to conform or comply with applicable laws or to protect the rights, property, or safety of visitors to the Discflo Website, Discflo’s partners or customers, or the public; and (xiv) processing or engaging in a sale of all or part of Discflo’s business or if Discflo otherwise goes through a reorganization or merger.

Discflo may also share Personal Information and other information with Discflo affiliates and business partners, as well as with other third-party service providers who help Discflo provide operational services for the Discflo Website and business, which might include, but is not necessarily limited to: business entities that provide e-mail address management and communication contact services, retargeting services, network equipment and application management providers and hosting entities, entities which obtain information such as demographic information which might be aggregated with information we have about You, entities that allow Discflo to personally identify visitors to the Discflo Website, judicial, administrative and/or legal or financial accounting providers in the event that information must be reviewed or released in response to civil and/or criminal investigations, claims, lawsuits, or if Discflo is subject to judicial or administrative process (such as a subpoena) to release Your information or to prosecute or defend legal actions, and other service providers which may be involved in the other types of services and activities otherwise discussed in this Privacy Policy. Discflo may also use Your Personal Information to contact You in ways other than e-mail or regular mail, such as via telephone or facsimile. All use of Personal Information will be as permitted by applicable law.

Opting Out and Updates to Your Personal Information. Discflo does not rent, sell, or share Your Personal Information with other parties or non-affiliated companies for their direct marketing purposes without Your express consent. Discflo provides You the opportunity to opt out of receiving marketing communications from Discflo and its agents, subsidiaries, affiliates, partners, successors, and assigns and gives You the option to remove Your information from the Discflo Website, to not receive future marketing communications, or to no longer receive access to the Discflo Website and any services that may be obtained through the Discflo Website; You may email marketing@discflo.com or by sending a written request to the address provided in the section of this Privacy Policy entitled “Notice” to opt out of future Discflo marketing communications, if You receive any unsolicited Discflo marketing communication, and/or to remove Your information from the Discflo Website.

You may also make requests regarding Your Personal Information, such as requests to access information, requests to update or correct inaccurate information, or to have Discflo delete Your Personal Information, by sending a written request to Discflo identifying the requestor and stating what Personal Information is requested for removal, via the methods of providing notice to Discflo, as set forth in the section of this Privacy Policy entitled “Notice.” Discflo will remove Your Personal Information within a reasonable time period of receipt of Your written request, and only after Discflo has verified the identity of the requestor. Discflo may retain and use information in its records as described in this Privacy Policy and as required by law.

Security and Retention of Personal Information. Discflo follows generally accepted industry standards to store and protect Personal Information, secure servers, databases only accessible by those authorized with special access rights to such systems, and routine monitoring of these systems and data. No method of electronic data transmission or storage is completely secure, and for this reason, there is no guarantee that information will not be accessed, disclosed, altered, or lost or destroyed by breach of any of Discflo’s physical, technical, or managerial safeguards. DISCFLO EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESSED OR IMPLIED, WITH RESPECT TO ENSURING, GUARANTEEING, OR OTHERWISE OFFERING ANY DEFINITIVE PROMISE OF SECURITY IN CONNECTION WITH YOUR PERSONAL INFORMATION, AND FURTHER DISCLAIMS ANY LIABILITY THAT MAY ARISE SHOULD ANY OTHER INDIVIDUALS OBTAIN THE PERSONAL INFORMATION YOU HAVE SUBMITTED TO THE DISCFLO WEBSITE. Discflo keeps Your personal data only as long as necessary to provide You with access to the Discflo Website, services obtained through the Discflo Website, and other legitimate and essential business purposes.

General Data Protection Regulation. In the event Discflo shares Personal Information with third parties pursuant to the terms of this Privacy Policy, and those third parties are located in countries other than Your home country, such Personal Information may be subject to privacy laws that are different from those in Your country of residence. Discflo is headquartered in Santee, California, and does not anticipate collecting Personal Information from individuals residing in the European Union; however, in the event that any transaction related to the Discflo Website or services obtained through the Discflo Website involves the transmission of Personal Information by an individual located in the European Union, any such transfer will comply with General Data Protection Regulation requirements. If You are visiting the Discflo Website from a location outside of the United States, please be aware that Your connection to the Discflo Website may be through servers located in the United States. Furthermore, please be aware that the data protection laws in the United States or other countries may not be the same as those in Your country where You are connecting to the Discflo Website. By using the Discflo Website and/or submitting information to Discflo, You specifically consent to the transfer of Your information to the United States to the facilities and servers Discflo uses, and to those with whom Discflo may share Your information.

Privacy Practices of Third Parties and Links. Discflo may display advertisements or other content that is from and/or links to third-party websites. Discflo cannot control or be held responsible for the content and privacy practices of any third party or third-party website, application, link, or other third-party service. If You click on third-party content or links, please be aware that You are leaving the Discflo Website and any Personal Information or other information that You provide to any third party will not be covered by this Privacy Policy.

Discflo encourages our suppliers, vendors, agents, subsidiaries, affiliates, partners, successors, and assigns to adopt and post privacy policies. However, the use of Your Personal Information by such parties is governed by the privacy policies of those parties and is not subject to Discflo’s control. When You choose to interact with any of Discflo’s suppliers, vendors, agents, subsidiaries, affiliates, partners, successors, assigns, or any other third party, it is encouraged that You read any applicable privacy policy posted by that particular party.

Use of Google AdWords for Remarketing. Discflo uses remarketing services to advertise on third-party websites (including Google) to previous visitors to the Discflo Website. This means that Discflo may provide advertisements or marketing to previous visitors who have started but not completed a request on the Discflo Website (i.e., using a contact form to make an inquiry but only partially completing the form). This could be in the form of an advertisement on the Google search results page or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past website visits. Any such data collected will be used in accordance with this Privacy Policy and Google’s privacy policy. You can set preferences for how Google advertises to You using the Google Ad Preferences page. You may also elect to opt out of interest-based advertising entirely through cookie settings or permanently using a browser plugin.

Children’s Online Privacy Protection Act. Discflo does not intend or permit any individuals under the age of eighteen to use the Discflo Website or obtain any services related to the Discflo Website, and any such use by any individual under the age of eighteen is prohibited. By using the Discflo Website, You represent that You are at least eighteen years of age and understand that You must be eighteen years old to register and receive access to the Discflo Website. Discflo will promptly delete any information associated with any records where Discflo obtains actual knowledge that this policy is being breached.

California Privacy Rights. Pursuant to §1798.83 of the California Civil Code, residents of California can obtain certain information about the types of Personal Information that companies with whom they have an established business relationship have shared with third parties for direct marketing purposes during the preceding calendar year. In particular, the law provides that companies must inform consumers about the categories of personal information that have been shared with third parties, the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. To request a copy of the information disclosure provided by Discflo pursuant to §1798.83 of the California Civil Code, please contact Discflo as provided in the Notice section of this Privacy Policy.

California Consumer Privacy Act (“CCPA”). Pursuant to §1798.100 of the California Civil Code, residents of California are provided specific legal rights regarding personal information. These rights include: 1) the right to request that a business disclose the specific personal information collected; 2) a business shall inform consumers at or prior to the point of collection as to the categories of personal information not be collected and for what purposes it will be used; 3) a business will only disclose personal information to a consumer upon receipt of a verifiable consumer request; 4) a business is required to respond to verifiable customer requests to access personal information at least twice in a twelve (12) month period; and 5) information from a one-time transaction that is not sold or retained by the business does not need to be retained by the business.

Please be aware that Discflo cannot respond to a request if Discflo cannot sufficiently verify the identity of the requestor or if the request lacks sufficient details to enable Discflo to facilitate the request.

All notices to You regarding this Privacy Policy will be sent via e-mail to Your email address on file with Discflo at the time of the sending of the notice; if Discflo does not have Your email address on file, then notice to You will be provided by first-class mail. Discflo reserves the right to update this Privacy Policy; any such changes are deemed effective as of the earlier date between either the date You receive notice of the changes or 30 days after the date such updated terms are published on the Discflo Website. Thereafter, continued usage of the Discflo Website and/or any services obtained through the Discflo Website constitutes acceptance of any new terms and/or modifications to the Privacy Policy.
